Background information: Ewen Maclean is a hugely experienced expert in the field of forensic schedule / programme analysis; delay and disruption; and associated prolongation costs in relation to construction and engineering projects. Ewen also has added value in quantum and design capabilities as a chartered civil engineer (FICE and FCIArb). In particular, he is highly skilled in disentangling complex issues and vast quantities of data into simple persuasive arguments and solutions. Considerable IT skills also allow Ewen to carry out work efficiently and economically without the requirement of significant additional resources.

Ewen has worked for both international consultants and contractors and has first-hand experience of assisting and representing clients in litigation, arbitration, mediation and adjudication, both for the claimant and respondent. He has prepared numerous expert witness reports; drafted standard forms of contract and lectured extensively on various commercial and contractual subjects within the construction industry. Speaking appointments have included the FIDIC International Contract Users’ Conference; Project Controls Expos, Built Intelligence Conferences; Keating Chambers; numerous city law forms as well as employers, contractors; and miscellaneous public events.

Ewen is well versed in many of the standard forms of construction contract including the NEC, FIDIC, JCT, ICE, GC Works Conditions as well as bespoke forms of contracts including PFI contracts and has worked on contracts that span, inter alia, major building including mixed use developments; civil engineering; petrochemical including oil and gas; energy (HEP); mechanical and electrical, pharmaceutical; infrastructure including bridges, highways, rail and guided busways; structural steelwork; and fit-out works. Ewen has also acted in commercial negotiations and settlements, resolving potential disputes as well as providing advice on contract procurement.
