We have just recieved another EOT claim from the contractor, showing 2 delaying events on the Critical Path by the employer equalling 93 calender days. However, using the windows analysis i get 72 calender days.
Event 1 @ month 3 = 63 days
At month 5 contractor pulls back 21 days due to rescheduling (progressing activities concurrently on the CP).
Event 2 @ month 6 = 30 days.
At month 8 alot more slippage due to contractor!!!
What should be entitlement because if the contractor can easily reschedule the activities, then should these be deemed invalid links on the agreed baseline programme. However, trying to get them to break another link as per instruction, arms start to wave in terms of actual costs. (NEC3).
